Terms of Service

These Terms of Service ("Terms") govern use of the Illuminator system and related services (collectively, the "Illuminator") provided by N0X ("N0X," "we," "us"). The Illuminator was created by Khalif Neville and is operated through N0X.

1. Acceptance of Terms

By sending a message to, engaging with, loading content into, or otherwise using the Illuminator, you acknowledge and agree to these Terms. A notice referencing these Terms is presented within the Illuminator interface; continued use after that notice constitutes acceptance. If you use the Illuminator on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes that organization. You must be of legal age to form a binding contract in your jurisdiction. If you do not agree to these Terms, do not use the Illuminator.

2. Nature of the Illuminator System

The Illuminator is an application-agent interface designed to provide informational guidance, routing support, structured responses, and brand-aligned interaction under defined operational constraints. The Illuminator is not an autonomous decision-maker, professional advisor, emergency service, or substitute for qualified human review.

The Illuminator system includes interface logic, prompt and context configuration, retrieval or reference pathways where enabled, safety boundaries, and response-formatting behavior. Natural-language responses are generated through one or more underlying artificial intelligence models, which may be provided by third-party model providers or other external infrastructure providers. The Illuminator layer does not possess human judgment, professional licensure, independent agency, or autonomous legal authority. It operates only when invoked through user interaction, configured context, and available model services.

3. Model Dependency

You acknowledge that the Illuminator depends on underlying AI models to generate, transform, summarize, classify, or otherwise produce language-based outputs. These models are probabilistic systems and may produce incomplete, inaccurate, outdated, biased, unexpected, inappropriate, or otherwise unsuitable outputs.

To the maximum extent permitted by law, N0X is not responsible for model behaviors, model failures, model hallucinations, third-party model outages, third-party model policy changes, or other model-generated outputs arising from systems outside N0X's direct control, except where liability cannot legally be excluded or where the issue is caused by N0X's own willful misconduct, gross negligence, or breach of an express written obligation.

4. No Reliance Without Human Review

All Illuminator outputs are provided for informational, organizational, routing, drafting, or decision-support purposes only. You are responsible for independently reviewing and validating outputs before relying on them, publishing them, transmitting them, using them in business operations, or making decisions based on them.

You must not treat Illuminator outputs as final professional advice — including legal, medical, financial, tax, safety, or compliance advice, or any other regulated professional judgment — unless the output has been reviewed and approved by a qualified professional responsible for that decision.

5. Professional and Intended Use

The Illuminator is designed for professional, informational, brand-guidance, customer-support, workflow-support, and structured interaction use cases. It is not designed for emergency response, crisis intervention, diagnosis, regulated decision-making, employment eligibility decisions, credit decisions, insurance underwriting, law enforcement determinations, medical treatment decisions, or other high-stakes uses unless N0X has expressly agreed in writing to a specific deployment scope with appropriate safeguards, review procedures, and compliance controls.

You agree not to use the Illuminator for unlawful, harmful, deceptive, abusive, exploitative, or unauthorized purposes, or in any way that exceeds the intended deployment scope communicated by N0X.

6. User Responsibility for Inputs, Configuration, and Use

You are responsible for the information, prompts, files, instructions, context, brand materials, data, and other inputs you provide to the Illuminator. You represent that you have the necessary rights, permissions, and authority to provide such materials and to use the Illuminator in connection with them.

You are responsible for determining whether Illuminator outputs are appropriate for your intended use. Where you deploy, publish, forward, integrate, or act upon an Illuminator output, you are responsible for that downstream use and for any decisions made in reliance on that output.

7. Intellectual Property

The Illuminator system — including its interface, architecture, configuration formats, protocols, and associated branding — is the protected intellectual property of Khalif Neville and N0X. These Terms grant you a limited, non-exclusive, non-transferable right to use the Illuminator as deployed and do not transfer any ownership interest in the system. You retain your rights in the inputs you provide. Subject to these Terms and applicable third-party model terms, you may use outputs generated for you, provided you remain responsible for their review and downstream use as described in these Terms.

8. Privacy and Data Handling

By default, the Illuminator operates in a privacy-preserving posture: chat transcripts are not stored server-side by default, and active chat state lives in your browser. Optional persistence modes (such as browser storage or a cloud-synced account) store data only when you affirmatively enable them. Uploaded files are temporary session artifacts and are automatically deleted after session end or timeout. Use of the Illuminator may involve transmission of your inputs to third-party model providers for processing. Additional privacy details may be published at the applicable N0X policy page and are incorporated by reference where posted.

9. Third-Party Services and Infrastructure

The Illuminator may rely on third-party model providers, hosting providers, payment processors, communications providers, analytics providers, APIs, or other external services. N0X does not control all aspects of third-party services and is not liable for third-party outages, policy changes, data-processing failures, model changes, latency, downtime, security incidents, or service interruptions except to the extent required by applicable law or expressly agreed in writing. Use of the Illuminator may also be subject to third-party terms, policies, rate limits, and technical constraints.

10. No Warranty of Accuracy or Fitness

To the maximum extent permitted by law, the Illuminator and all outputs are provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. N0X does not warrant that the Illuminator will be uninterrupted, error-free, fully accurate, current, complete, secure against all possible threats, suitable for every use case, or free from model-generated errors. N0X does not warrant that any output will achieve a specific business result, conversion rate, cost savings, compliance outcome, legal outcome, customer outcome, or operational result.

11. Limitation of Liability

To the maximum extent permitted by law, N0X, its owners, operators, affiliates, contractors, and service providers shall not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, including loss of revenue, loss of goodwill, loss of data, business interruption, reputational harm, or downstream reliance harms arising from or related to use of the Illuminator or any model-generated output.

To the maximum extent permitted by law, N0X's total aggregate liability for any claim arising out of or relating to the Illuminator shall not exceed the greater of: (a) the amount paid by you to N0X for the applicable Illuminator service during the twelve (12) months preceding the claim, or (b) one hundred dollars ($100), unless a different amount is expressly agreed in a signed written agreement.

Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, N0X's liability shall be limited to the maximum extent permitted by applicable law.

12. No Liability for Prohibited or Unauthorized Use

N0X is not liable for harms, losses, claims, or damages arising from: unauthorized use; use outside the intended deployment scope; use in prohibited or high-risk contexts; failure to review outputs; modification of outputs by users or third parties; integration into systems not approved by N0X; reliance on outputs as final professional advice; or use of the Illuminator in violation of these Terms, applicable law, third-party terms, or written instructions provided by N0X.

13. Human Oversight and Approval

You acknowledge that the Illuminator is intended to support, not replace, human judgment. You are responsible for maintaining appropriate human oversight, approval workflows, escalation paths, and review procedures for your deployment context. Where an Illuminator is used in a business, institutional, educational, medical, financial, legal, employment, public-sector, or similarly sensitive context, you are responsible for ensuring that appropriate policies, review procedures, notices, consents, and compliance controls are in place.

14. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless N0X, its owners, operators, affiliates, contractors, and service providers from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to: your inputs; unauthorized or prohibited use; reliance on outputs without appropriate review; your publication or deployment of outputs; violation of these Terms; violation of law; violation of third-party rights; or integration of the Illuminator into systems or workflows you control.

15. No Emergency or Critical Use

The Illuminator is not an emergency service. You must not rely on the Illuminator for emergency communications, urgent medical needs, crisis response, public safety emergencies, legal deadlines, financial emergencies, or other time-critical or safety-critical situations. In an emergency, contact appropriate emergency services, qualified professionals, or authorized institutional contacts.

16. Changes to Models, Services, and These Terms

You acknowledge that underlying models, infrastructure, safety filters, APIs, retrieval sources, and service behavior may change over time. N0X may update, modify, replace, suspend, or discontinue model connections or service features when necessary for performance, security, compliance, cost control, provider availability, or product improvement. Where reasonable and commercially practical, N0X may provide notice of material changes affecting paid deployments, but N0X does not guarantee that model behavior will remain identical over time.

N0X may update these Terms by posting a revised version at the applicable N0X policy page. Continued use after posting constitutes acceptance of the revised Terms.

17. Express Carve-Outs

Nothing in these Terms excludes liability where such exclusion is prohibited by law. Nothing in these Terms limits liability for willful misconduct, fraud, or other liability that cannot legally be limited. Nothing in these Terms reduces any express written obligation N0X has separately agreed to in a signed contract.

18. General Provisions

Governing Law: These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, except where the mandatory consumer protection laws of your jurisdiction apply and cannot be waived by agreement. Venue: any dispute arising out of or relating to these Terms or the Illuminator that is not subject to a mandatory alternative forum shall be brought in the state or federal courts located in Massachusetts, and you consent to the jurisdiction of those courts. Severability: if any provision is held unenforceable, the remaining provisions remain in full effect, and the unenforceable provision shall be enforced to the maximum extent permitted. No Waiver: failure to enforce a provision is not a waiver. Entire Agreement: these Terms, together with any signed written agreement between you and N0X, constitute the entire agreement regarding the Illuminator; in the event of conflict, a signed written agreement controls. 19. Plain-Language Summary (Non-Operative)

The Illuminator is an AI-powered guidance interface. It uses underlying AI models that can make mistakes. Outputs are informational and must be reviewed by a responsible human before being relied on, published, or used for decisions. N0X is not responsible for misuse, unreviewed reliance, third-party model behavior, or use outside the intended deployment scope, except where the law does not allow liability to be limited.
